How Long Do I Have to File a Personal Injury Claim in Missouri?
According to the Missouri Code section 516.120, you have five years to file a personal injury claim before the statute of limitations runs out. If the statute of limitations runs you will almost certainly lose your right to file a claim along with your right to recover compensation.
There are exceptions that can extend or shorten the amount of time you have to file so it’s important to contact an attorney as soon as you can to discuss your case. We offer free consultations, so you have nothing to lose by contacting our firm today.
What Damages Can I Recover in a Personal Injury Claim?
While the specific amount of compensation and individual can recover depends widely on the specifics of your case, the types of damages an injury victim can pursue remain the same. These types of damages are economic damages, non-economic damages and punitive damages.
Economic damages, as the name suggests, compensate an injured party for the financial losses they suffer that as associated with their injuries, such as medical expenses or missed days at work. Non-economic damages compensates an injured party for the non-financial suffering associated with their injury, like pain and suffering, or mental anguish.
The last type of damages differ from the first two in that their main purpose is to punish the negligent party instead of compensate for an injury, as such they are not often awarded.
